1. Who we are

BorrowProof is operated by:

  • Operator: BorrowProof — DELVE SOFTWARE
  • Legal form: sole proprietorship
  • Registered office: Kapellelaan 124, 1950 Kraainem, Belgium
  • Enterprise number: 1037.658.191
  • VAT status: Belgian small-enterprise VAT exemption regime, Article 56bis of the VAT Code. No VAT is charged.

BorrowProof is a Belgian small enterprise serving consumers and businesses across the EU and the euro area.

2. The service and no-advice disclaimer

BorrowProof provides general information to compare loan rates for your own orientation only. It is not financial, credit, legal or tax advice and is not a personalised recommendation.

BorrowProof is not a lender, credit broker or credit intermediary and is not regulated by the FSMA. Always verify terms directly with the relevant lender before making any decision.

BorrowProof compares the rate you enter against publicly available benchmark and market-related information, including European Central Bank MIR statistics. ECB data is official but is published with a lag and may be revised. We do not guarantee that any benchmark, comparison, verdict, report or output is error-free, complete, current or suitable for your specific situation.

3. Account and eligibility

An account is required to use the service. You must provide accurate information, keep your credentials secure, and be of legal age. The service is not intended for minors.

4. Price, payment and term

Paid access costs a one-time €25 and gives access to paid features for 30 calendar days from successful payment. It is a one-time payment with no automatic renewal; access reverts to the free tier when it expires.

BorrowProof applies the Belgian small-enterprise VAT exemption regime. No VAT is charged and the €25 price shown is the final, all-in price. An invoice is issued for every payment.

Because the service is supplied digitally and immediate access is provided, paid access is not refundable except where mandatory consumer law provides otherwise.

5. Right of withdrawal and consumer rights

If you are a consumer, you normally have 14 days to withdraw from a distance purchase.

Because BorrowProof is a digital service supplied immediately after payment, you will be asked at checkout to expressly request immediate access before the end of the 14-day withdrawal period and to acknowledge that this affects your right of withdrawal.

By requesting immediate access and completing the purchase, you agree that BorrowProof may start providing the paid digital service immediately. You acknowledge that, once access to the paid digital service has started or the service has been fully performed, you may lose your right of withdrawal to the extent permitted by applicable consumer law.

We may record your request and acknowledgement and confirm them by email, invoice, account confirmation, or another durable medium.

Consumers also benefit from the mandatory legal guarantee rules for digital content and digital services where applicable.

Nothing in these Terms limits any mandatory right you have as a consumer.

6. Liability

BorrowProof is provided with reasonable care but without any guarantee that the service, data, comparisons, verdicts, reports or outputs will be uninterrupted, error-free, complete, current or suitable for your specific situation.

To the maximum extent permitted by law, we are not liable for decisions made on the basis of the service, and our total liability is limited to the amount you paid for the relevant access period.

Nothing in these Terms excludes or limits liability that cannot be excluded under Belgian law, including liability for fraud, intentional misconduct or mandatory consumer rights.

7. Changes and termination

We may update the service or these Terms from time to time. The version on this page is the current version and the date above shows when it was last revised.

We may suspend or end access in the event of misuse, including scraping, bulk extraction, attempts to interfere with the service, or unlawful use.

8. Governing law and disputes

These Terms are governed by Belgian law. If you are a consumer, you also keep the mandatory protections of the law of your country of habitual residence.

Disputes may be brought before the competent courts in Brussels, Belgium, subject to mandatory consumer rules.

Consumers may also refer a dispute to the Service de Médiation pour le Consommateur / Consumentenombudsdienst, Boulevard du Roi Albert II 8, 1000 Brussels, Belgium.
